Terms of Service

These Terms of Service ("Terms") govern access to and use of Tanzamail’s website and invitation-only email services. By requesting access, using our services, or interacting with our team you accept and agree to be bound by these Terms and any related policies.

1. Definitions

"Service" means Tanzamail's invitation-only email platform and related online services. "Member" means an individual or organization approved to use the Service. "You" and "User" include applicants, invitees, and Members.

2. Eligibility, Invitation & Onboarding

Tanzamail is provided by invitation or approved request only. Applicants must provide accurate information and may be subject to verification checks. Approval is discretionary and may include identity verification, affiliation checks, or reference validation. We reserve the right to refuse or revoke access for any lawful reason.

3. Account Responsibility & Security

Members are responsible for maintaining the confidentiality of account credentials and any activity under their account. You must notify us promptly of suspected unauthorized access. You may not share credentials or use another Member’s account without explicit permission.

4. Acceptable Use & Prohibited Activities

The Service must be used in compliance with applicable law and these Terms. Prohibited activities include but are not limited to:

• Sending unlawful, threatening, harassing, or hateful communications;
• Bulk unsolicited commercial messaging (spam) or misuse of mass-mailing features;
• Distribution of malware, phishing, or intentionally deceptive content;
• Attempting unauthorized access to systems, accounts, or data;
• Using Tanzamail to facilitate illegal activities or serious policy violations.

5. Content, Ownership & Monitoring

Members retain ownership of their content. Tanzamail may process, transmit, and store Member communications to provide the Service. We do not claim ownership of Member content. We may monitor usage for security, compliance, abuse prevention, and quality assurance, subject to privacy protections described in our Privacy Policy.

6. Service Levels, Availability & Limitations

We aim to provide high availability and reliable delivery but do not guarantee uninterrupted service. Except as provided in a separate written agreement, the Service is provided "as is" and "as available." Performance targets, if any, are aspirational unless contracted otherwise.

7. Fees & Payment

If any paid features or enterprise arrangements are offered, fees and billing will be set out in a separate agreement. Failure to pay applicable fees may result in suspension or termination of paid features.

8. Suspension & Termination

We may suspend or terminate access for breach, abuse, security risks, or to comply with legal obligations. Termination does not limit rights to pursue remedies or recovery of amounts owed. Upon termination, account data may be retained or deleted according to our retention policies and Privacy Policy.

9. Privacy & Data Processing

Our Privacy Policy describes how we collect, use, share, and retain personal data. By using the Service you consent to processing as described there. For enterprise customers, specific processing agreements may apply.

10. Warranties & Disclaimers

To the fullest extent permitted by law, Tanzamail disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or secure against every threat.

11. Limitation of Liability

Except where prohibited by law, Tanzamail’s aggregate liability arising out of or related to these Terms will not exceed the amounts paid to Tanzamail for the Service in the prior 12 months (if any). We are not liable for indirect, incidental, special, or consequential damages.

12. Indemnification

You agree to indemnify and hold Tanzamail harmless from claims, damages, losses, or costs (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.

13. Governing Law, Dispute Resolution & Arbitration

These Terms are governed by the laws of Tanzania. Parties will seek to resolve disputes informally; if unresolved, disputes will be subject to the exclusive jurisdiction of Tanzanian courts unless otherwise agreed in writing. For certain commercial arrangements we may agree alternative dispute resolution terms in a written contract.

14. Export Controls & Compliance

You shall comply with all applicable export, sanctions, and import laws. Access to the Service may be restricted where prohibited by local law or government measures.

15. Changes to Terms

We may update these Terms occasionally. Material changes will be posted with an updated effective date. Continued use after notice constitutes acceptance. Non-material changes may take effect immediately.
